2.2. Our reports provide a snapshot of the property's condition on the date and time of the inspection.

2.3. Non-Destructive Inspection: Unless explicitly agreed otherwise in writing, all inspections are visual and non-destructive. We will not lift floorboards, move heavy furniture, empty cupboards, or perform invasive testing. We cannot report on defects that are hidden, concealed, or otherwise inaccessible.

3. Bookings, Fees, and Payment

3.1. All bookings are subject to availability and written confirmation by us.

3.2. Fees for our services will be clearly stated at the time of booking. All fees must be paid in full prior to the release of the final assessment report, unless you hold an approved credit account with us.

3.3. We reserve the right to withhold the delivery of any reports, certificates, or findings until full payment has been received.

4. Client Obligations and Property Access

4.1. By confirming a booking, you confirm that:

(a) You are the owner of the property; OR

(b) You have obtained explicit permission from the property owner, tenant, or managing agent to grant our inspector access to the property at the scheduled time.

4.2. You must ensure that safe, unobstructed access is provided to all areas of the property required for the assessment.

4.3. If our inspector is unable to access the property at the agreed time (e.g., due to incorrect keys, tenants refusing entry, or unsafe conditions), a wasted journey fee of £25 will be charged.

5. Cancellations and Rescheduling

5.1. You may cancel or reschedule an appointment up to 1 week before the scheduled inspection time without penalty.

5.2. Cancellations made within 1 week of the scheduled appointment may be subject to a cancellation fee of £25 to cover allocated inspector time.

5.3. We reserve the right to cancel or reschedule an inspection due to unforeseen circumstances (e.g., severe weather, inspector illness). In such cases, we will offer an alternative date or a full refund.

6. Limitations of Liability

6.1. The Property Auditor provides independent, evidence-based condition and compliance reporting. However, our reports do not constitute a structural survey, building warranty, or guarantee against future defects.

6.2. We shall not be held liable for any faults, defects, or compliance failures that develop after the date of the inspection, or which were intentionally concealed from our inspectors.

6.3. Our total liability to you for any claim arising out of or in connection with our services (whether in contract, tort, negligence, or otherwise) shall be limited to the total fee paid by you for the specific service in question.

6.4. Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud.

7. Reliance on Reports and Third Parties

7.1. Our reports are prepared solely for the use of the client who commissioned them.

7.2. We accept no liability to any third party (such as subsequent purchasers, lenders, or tenants) who may choose to rely on the contents of our reports, unless third-party reliance has been explicitly agreed in writing prior to the inspection.

8. Intellectual Property

8.1. All intellectual property rights in the reports, photographs, and documentation produced by us remain the property of Everybase Ltd.

8.2. Upon full payment, you are granted a non-exclusive, non-transferable license to use the report for the purpose for which it was commissioned (e.g., securing a tenancy, property management, or evidencing a deposit deduction claim).

9. Data Protection and Privacy

9.1. We will process any personal data collected during the booking and inspection process in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

9.2. Personal data, including your name, contact details, and property address, will be used solely for fulfilling our contractual obligations to you. Full details can be found in our Privacy Policy.

10.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

10.2. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
